Article 2: SUBJECT
This agreement outlines the terms and conditions for the sale and delivery of the product, whose specifications and sales price are detailed below, ordered electronically by the BUYER from the website www.milstok.com owned by the SELLER. It sets forth the rights and obligations of both parties in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on the Principles and Procedures of Distance Contracts.
Article 3: PRODUCT SUBJECT TO THE AGREEMENT
The type and kind, quantity, brand/model, color, and sales price of the products are as specified above.
Article 4: GENERAL PROVISIONS
4.1 - The BUYER acknowledges that they have read and understood the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the contract on the website www.milstok.com and has given the necessary confirmation electronically.
4.2 - The product subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated by the BUYER, within the period specified in the preliminary information on the website, depending on the BUYER's place of residence, provided that it does not exceed the legal period of 30 days for each product.
4.3 - If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the person/organization to be delivered does not accept the delivery.
4.4 - The SELLER is responsible for delivering the product subject to the contract in a sound, complete manner, in accordance with the specifications indicated in the order, and with warranty documents and user manuals, if any.
4.5 - For the delivery of the product subject to the contract, a signed copy of this agreement must be delivered to the SELLER and the price must be paid by the BUYER in the form of payment preferred by the BUYER. If for any reason the product price is not paid or is canceled in the bank records, the SELLER is deemed to be released from the obligation to deliver the product.
4.6 - After the delivery of the product, if the BUYER's credit card is used unlawfully by unauthorized persons in a manner not caused by the BUYER's fault, and the relevant bank or financial institution does not pay the product price to the SELLER, the BUYER is required to send the product back to the SELLER within 3 days, provided it has been delivered to the BUYER. In this case, the transportation costs are borne by the BUYER.
4.7 - If the SELLER cannot deliver the product subject to the contract within the stipulated time due to force majeure or extraordinary circumstances such as adverse weather conditions or disruption of transportation, the SELLER is obliged to notify the BUYER of the situation. In this case, the BUYER may exercise one of the rights to cancel the order, replace the product subject to the contract with its equivalent if available, and/or postpone the delivery period until the blocking situation is eliminated. If the BUYER cancels the order, the amount paid is refunded to them in cash and in full within 10 days.
4.8 - Defective or damaged products from the products sold with or without a warranty certificate can be sent to the SELLER for the necessary repair within the warranty conditions, in which case the shipping costs will be covered by the SELLER.
4.9 - This agreement becomes valid after being signed by the BUYER and delivered to the SELLER via fax or mail.
Article 5: RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the contract within 14 days from the delivery of the product to the BUYER or the person/organization at the address indicated by the BUYER. To exercise the right of withdrawal, the BUYER must notify the SELLER via fax, email, or telephone within this period and the product must be unused in accordance with the provisions of Article 6. In case of exercising this right, it is mandatory to return the original invoice and the delivery note indicating that the product delivered to the third party or the BUYER has been sent back to the SELLER. Within 7 days following the receipt of these documents, the product price is refunded to the BUYER. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded. The shipping cost of the returned product due to the right of withdrawal is covered by the SELLER.
Article 6: PRODUCTS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, products that are damaged by the BUYER, and products that pose future operational malfunctions and failures. The right of withdrawal can only be exercised if the product's packaging is unopened, intact, and the product has not been used.
Article 7: AUTHORIZED COURT
In the implementation of this agreement, Consumer Arbitration Committees and Consumer Courts at the location of the BUYER or SELLER are authorized up to the value announced by the Ministry of Industry and Trade. In case the order is realized, the BUYER is deemed to have accepted all the terms of this agreement.
